Bonding Requirements for Food Service Management Companies and other Subcontractors

Under previous interpretation of 2 CFR 200.325, FNS communicated that “subcontracts exceeding the Simplified Acquisition Threshold” not only applied to subcontracts related to construction or facility improvement contracts, but also applied to Food Service Management Companies (FSMCs) as the contracts they have with School Food Authorities (SFAs) were considered to be subcontracts and, therefore, fell under the scope of the bonding requirements in 2 CFR 200.325

Section 107 of the Child Nutrition and WIC Reauthorization Act of 2004 (Act) amended section 9(b) of the Richard B. Russell National School Lunch Act to make runaway, homeless and migrant children categorically eligible for free meal benefits under the National School Lunch and School Breakfast Programs and is effective July 1, 2004.

Child Nutrition State Administrative Expense (SAE) Funds Reauthorization 2004 Implementation Memo CN 2

Section 202 of the Child Nutrition and WIC Reauthorization Act of 2004 (the Act) amended Section 7 of the Child Nutrition Act of 1966 to increase the minimum SAE grant level to states. In addition, for fiscal years (FY) 2005 through 2007, it maintains each state’s SAE grant at not less than the amount the state received for FY 2004.
