SNAP - Treatment of Household Members with Voided Puerto Rican Birth Certificates

On December 22,2009, Puerto Rico passed Law 191 of 2009 (S.8. 1182) that voids all Puerto Rican birth certificates issued prior to July 1, 2010. Current Puerto Rican birth certificates remain valid until the July I, 2010 effective date of the new law. As a result of this recent legislation, Food and Nutrition Service (FNS) has been asked to provide guidance to State agencies as to the treatment of voided Puerto Rican birth certificates for SNAP purposes.

SNAP - Clarification - Issuance of Benefits When Household Is Ineligible in the Initial Month of Application

It has come to our attention that some State agencies are not in compliance with the requirement to issue a household's initial month of benefits within 30 days of the date of application. A survey of a number of States indicates that many State agencies handle initial issuances differently for those households that are determined ineligible for benefits in the month of application (e.g., the household is over income) but eligible for benefits in the subsequent month.

SNAP - Standard Utility Allowance (SUA) Annual Review and Adjustment Waiver for Certain States - Modification and Extension

Due to the impact on SNAP benefits resulting from continuing fluctuations in energy prices, the Food and Nutrition Service (FNS) is modifying the Standard Utility Allowance (SUA) blanket waiver memorandum of October 14,2010 to allow certain States to extend fiscal year (FY) 2010 SUA amounts through March 31, 2011.

Due to the impact on SNAP benefits resulting from drastically fluctuating energy prices, the Food and Nutrition Service (FNS) is extending the one-time blanket SUA waiver for an additional 3 months to certain States that would otherwise be ineligible for the waiver in fiscal year (FY) 2011.

Student Eligibility for the Supplemental Nutrition Assistance Program (SNAP)

This memo is in response to questions raised through Quality Control (QC) reviews related to student eligibility for SNAP benefits. Section 6(e) of the Food and Nutrition Act (the Act) of 2008 and Federal regulations at 7 CFR 273.5(a) prohibit students enrolled at least half-time in an institution of higher education from receiving SNAP benefits unless specific exemptions are met.

SNAP - Multi-Program Periodic Report Forms

Some State agencies have adopted a version of simplified reporting (SR) for other programs, such as Medicaid and the Temporary Assistance for Needy Families Program (TANF), and are using multi-program report forms for the various programs, including SNAP. A question has been asked whether multi-program reporting forms that request information required by the other programs but not by SNAP are permitted under SNAP regulations.

On June 21, 2010, Food and Nutrition Service issued policy guidance on how to treat household members whose Puerto Rican birth certificates were voided under Puerto Rico Law 191 of 2009. The SNAP policy was to go into effect July 1, 2010 to coincide with the effective date of the new law.
