ABAWD Waivers

An ABAWD time limit waiver does not waive the general SNAP work requirements. More information about waivers can be found by visiting: SNAP - Guide to Supporting Requests to Waive the Time Limit for Able-Bodied Adults without Dependents (ABAWD). As a result of the final rule, Supplemental Nutrition Assistance Program: Requirements for Able-Bodied Adults Without Dependents, which was published on December 5, 2019, the regulatory standards referenced in this guide are only valid through March 31, 2020. In order to have a waiver as of April 1, 2020, and thereafter, states must request a waiver that meets the new standards in 7 CFR 273.24(f) and should submit that request as soon as possible to their respective FNS regional office contact(s).

Requirements for Informing Households of ABAWD Rules

Section 6(o) of the Food and Nutrition Act of 2008, as amended (the Act), limits the time able-bodied adults without dependents (ABAWDs) can receive Supplemental Nutrition Assistance Program (SNAP) benefits to 3 months in any 36-month period, unless the individual meets the ABAWD work requirement or is otherwise exempt. The Food and Nutrition Service (FNS) has recently received questions about the State agency’s responsibility to inform SNAP households about the ABAWD time limit and work requirement.

SNAP - Statewide Able Bodied Adults Without Dependent (ABAWD) Waivers Effective Immediately for Eligible States

The American Recovery and Reinvestment Act of 2009 (ARRA suspends restrictions on Able Bodied Adults Without Dependent (ABAWD) participation in the Supplemental Nutrition Assistance Program (SNAP) as of April 1, 2009 continuing through Sept. 30, 2010, unless State agencies choose to impose specific work requirements.
