Pandemic Electronic Benefits Transfer (P-EBT) Questions and Answers for Retailers

FNS published the SNAP: P-EBT Integrity Final Rule, which is codified at 7 CFR 284.1. This rule requires FNS to treat P-EBT benefits the same as SNAP benefits for the purposes of identifying and sanctioning program violators.

Proposed Rule: Taking Administrative Actions Pending Freedom of Information Act (FOIA) Processing

The Food and Nutrition Service seeks to prevent firms authorized to participate in SNAP from delaying administrative actions, such as disqualification or civil money penalties, through submission of Freedom of Information Act (FOIA) requests or appeals. As such, FNS is proposing that FOIA requests and FOIA appeals be processed separately from administrative actions FNS takes against retail food stores. This proposed rule would ensure that retail food stores can no longer use the FOIA process to delay FNS' administrative actions to sanction a retail food store for SNAP violations.

Clarifications on Work Requirements, ABAWDs, and E&T

The Office of lnspector General's 2016 Audit Report, Food and Nutrition Service Controls over SNAP Benefits for Able Bodied Adults without Dependents, recommended that FNS perform analysis to identify problematic areas for states in terms of ABAWD policy and then provide states with additional best practices to address those areas.
