Requirements for Informing Households of ABAWD Rules

Section 6(o) of the Food and Nutrition Act of 2008, as amended (the Act), limits the time able-bodied adults without dependents (ABAWDs) can receive Supplemental Nutrition Assistance Program (SNAP) benefits to 3 months in any 36-month period, unless the individual meets the ABAWD work requirement or is otherwise exempt. The Food and Nutrition Service (FNS) has recently received questions about the State agency’s responsibility to inform SNAP households about the ABAWD time limit and work requirement.

ABAWD Waivers

States may request to waive the ABAWD time limit in areas with an unemployment rate above 10 percent or a lack of sufficient jobs. SNAP regulations provide a number of ways States can demonstrate that an unemployment rate above 10 percent or a lack of sufficient jobs. SNAP - Statewide Able Bodied Adults Without Dependent (ABAWD) Waivers Effective Immediately for Eligible States

The American Recovery and Reinvestment Act of 2009 (ARRA suspends restrictions on Able Bodied Adults Without Dependent (ABAWD) participation in the Supplemental Nutrition Assistance Program (SNAP) as of April 1, 2009 continuing through Sept. 30, 2010, unless State agencies choose to impose specific work requirements.
