Claims For Losses of Donated Foods and Related Administrative Losses - Procedures for the State Distributing Agency (FNS - Instruction 410-1)

The purpose of this instruction is to establish the general standards and procedures that the state distributing agency must follow in order to ensure that restitution is made for the loss of donated foods, or for the loss or improper use of funds provided for, or accruing from, the distribution of donated foods.

Updated Timeline for Conversion of the Emergency Food Assistance Program (TEFAP) Administrative and Food Funds

Due to the change in the implementation date for the Web-Based Supply Chain Management (WBSCM) system, the deadlines for State TEFAP agencies to convert TEFAP food and administrative funds as listed in the Oct. 23, 2009 memorandum entitled "Fiscal Year (FY) 2010 Funding for the Emergency Food Assistance Program" have been revised. These date changes will ensure that States have the ability to use their food and administrative funds efficiently this fiscal year, given the abbreviated food ordering timeline necessary for WBSCM implementation.

Food Distribution Program: Value of Donated Foods (July 1, 2010 - June 30, 2011)

This notice announces the national average value of donated foods or, where applicable, cash in lieu of donated foods, to be provided in school year 2011 (July 1, 2010 through June 30, 2011) for each lunch served by schools participating in the National School Lunch Program (NSLP), and for each lunch and supper served by institutions participating in the Child and Adult Care Food Program (CACFP).

Setting aside the Commodity Acceptability Reporting Requirement

In an effort to reduce reporting burden, the Food and Nutrition Service (FNS) is setting aside the requirement in 7 CFR 250.13(k) that the distributing agency submit a commodity acceptability report (form FNS-663) to FNS, utilizing information collected from recipient agencies in the National School Lunch Program, the Child and Adult Care Food Program, the Commodity Supplemental Food program, the Food Distribution Program on Indian Reservations, and the Nutrition Services Incentive Program.
