Simultaneous Participation in CSFP and other Nutrition Assistance Programs administered by the Food and Nutrition Service (FNS)

Per CSFP regulations at 7 CFR 247.19, participants are prohibited from receiving CSFP benefits and Special Supplemental Nutrition Program for Women, Infants, and Children (WIC Program) benefits at the same time. However, there is no prohibition against simultaneous participation in CSFP and other FNS programs including but not limited to the Supplemental Nutrition Assistance Program (SNAP), The Emergency Food Assistance Program, and the Senior Farmers' Market Nutrition Program, provided the eligibility requirements for these programs are met.

American Recovery and Reinvestment Act of 2009 Increases to Unemployment Compensation Payments

Section 2002 of Title II of the American Recovery and Reinvestment Act of 2009 (ARRA) authorizes a new temporary Federal Additional Compensation program that provides a $25 weekly increase in unemployment compensation for eligible workers. This increase is countable as income for CSFP, FDPIR and TEFAP purposes. The ARRA does not allow an income exclusion for these payments under any of these programs.

The guidance provided by this policy memorandum has been incorporated in 7 CFR 250.60, in accordance with the final rule, "Management of Donated Foods in Child Nutrition Programs, the Nutrition Services Incentive Program, and Charitable Institutions" (the FSMC final rule), which was published in the Federal Register on August 8, 2008, with an effective date of November 6, 2008.
