Allowability of Participant Payments and Contributions for Foods Donated by the United States Department of Agriculture (USDA) and/or Non-USDA Sources

This memorandum clarifies Food and Nutrition Service (FNS) regulations and policies regarding the allowability of requiring payment and soliciting contributions (i.e., "payments" or "pay") in exchange for foods from FNS program participants.

Simultaneous Participation in CSFP and other Nutrition Assistance Programs administered by the Food and Nutrition Service (FNS)

Per CSFP regulations at 7 CFR 247.19, participants are prohibited from receiving CSFP benefits and Special Supplemental Nutrition Program for Women, Infants, and Children (WIC Program) benefits at the same time. However, there is no prohibition against simultaneous participation in CSFP and other FNS programs including but not limited to the Supplemental Nutrition Assistance Program (SNAP), The Emergency Food Assistance Program, and the Senior Farmers' Market Nutrition Program, provided the eligibility requirements for these programs are met.

The guidance provided by these Policy Memoranda has been consolidated and clarified in Policy Memorandum FD-093, Questions and Answers about Disaster Policies and Procedures.

Food Distribution Program: Value of Donated Foods (July 1, 2009 - June 30, 2010)

Notice is hereby given that the national average minimum value of donated foods, or cash in lieu thereof, per lunch under the NSLP (7 CFR part 210) and per lunch and supper under the CACFP (7 CFR part 226) shall be 19.5 cents for the period July 1, 2009 through June 30, 2010.

American Recovery and Reinvestment Act of 2009 Increases to Unemployment Compensation Payments

Section 2002 of Title II of the American Recovery and Reinvestment Act of 2009 (ARRA) authorizes a new temporary Federal Additional Compensation program that provides a $25 weekly increase in unemployment compensation for eligible workers. This increase is countable as income for CSFP, FDPIR and TEFAP purposes. The ARRA does not allow an income exclusion for these payments under any of these programs.
